Section 9: Public Notice of Procurement Process or Sole Source Procurement

9.0 Public Notice of Procurement Process or Sole Source Procurement 

  1. When Utah State University conducts a formal sourcing event over the small dollar limit an invitation for bid (IFB), a request for proposal (RFP), or a notice of sole source procurement is required to be published in accordance with this section, shall provide public notice that includes:
    1. For an IFB or RFP, the name - Utah State University
    2. For an IFB or a RFP, information on how to contact Utah State University in relation to the IFB or RFP.
    3. For a notice of sole source procurement, contact information and other information relating to contesting, or obtaining additional information in relation to, the sole source procurement.
    4. The date of the opening and closing of the IFB or RFP.
    5. For a notice of sole source procurement, the earliest date that Utah State University may make the sole source procurement.
    6. Information on how to obtain a copy of the IFB, RFP, or further information related to the sole source procurement; and
    7. A general description of the procurement items that will be obtained through the standard procurement process or sole source procurement.

9.1 Notice for Invitation for Bid or Request for Proposal 

  1. Except as provided for an IFB or a RFP, Utah State University shall publish the notice described using at least one of the following methods:
    1. At least seven (7) days before the day of the deadline for submission of a bid or other response, publish the notice: 
      1. On the main website for Utah State University; or
      2. On a state website that is owned, managed by, or provided under contract with Utah State University for posting a public procurement notice.
    2. Utah State University may reduce the period as outlined in the Procurement Code.

9.2 Notice for Sole Source

  1. Except as provided, for a sole source procurement for which notice is required to be published, Utah State University shall publish the notice using at least one of the following methods:
    1. At least seven (7) days before the day on which Utah State University makes the sole source procurement, publish the notice: 
      1. On the main website for the Utah State University; or
      2. On a state website that is owned by, managed by, or provided under contract with Utah State University for posting a procurement notice.
    2. If making a sole sources procurement, Utah State University shall make a copy of information related to the sole source procurement available for public inspection at the main office of the Purchasing and Contract Services group or on the website.
