Employee Sexual Misconduct (Title IX) Training

All full-time and some part-time employees must complete a sexual misconduct (Title IX) training within 60 days of when they are a new employee and then again every year. The training's content is based on an employee's designation as either a reporting employee, designated confidential resource, or non-designated employee. 

The employee sexual misconduct (Title IX) trainings empower employees by teaching them how to recognize sexual misconduct behaviors, their obligations related to addressing sexual misconduct behaviors, how to respond to a sexual misconduct disclosure, and university and community support resources and reporting options.

Required Training Types

  • Designated Confidential Resource: medical professionals and medical staff, professional counselors, non-professional counselors, and advocates
  • Reporting Employee: employees who have the authority to institute corrective measures regarding allegations of sexual misconduct, such as Campus Security Authorities, university police, faculty, campus administrators, resident assistants, and supervisors
  • Non-Designated Employee: full-time and some part-time employees who are not designated confidential resources or reporting employees

Student Employees

Under interim USU policy 340, many student employees are not required to participate in an annual employee sexual misconduct (Title IX) training. Examples of student employees who are required to participate in a training include resident assistants, graduate teaching and research assistants, A-Team members, and Connections peer mentors.

The complete list of student employees who are required to participate in the training are included in interim USU policy 340. Units can request an employee sexual misconduct (Title IX) training for their student employees who are not required to participate by emailing prevention@usu.edu.

All new and continuing reporting employees and designated confidential resources will need to attend a "live" training. Employees at the Blanding, Eastern, and Logan campuses can attend either in-person or via Zoom. Employees at the Statewide Campuses will attend via Zoom.

Training Requirement

According to the university’s 2021 Sexual Misconduct Campus Climate Surveys, approximately 1 in 4 employees and 1 in 3 students at USU experienced some type of sexual misconduct (sexual harassment, sexual assault, relationship violence, or sex-based stalking) since coming to the university. As an employee at USU, you have a responsibility to report sexual misconduct (if you are a reporting employee), help support individuals who experience sexual misconduct, and connect them to the appropriate resources. 

The sexual misconduct (Title IX) training for employees is part of USU’s annual compliance training requirement. It will help you build skills to respond to disclosures of sexual misconduct, understand reporting requirements, and develop a general understanding of the sexual misconduct grievance process.

Generally, the employees required to attend this training are listed can be accessed via Interim USU Policy 340. If you’re required to attend a training, you’ll receive an email from the Office of Equity (prevention@usu.edu) to your @usu.edu email account.

If you’re a new employee, it can take up to 30 days from your start date before your paperwork is processed and you’re enrolled in a sexual misconduct (Title IX) training for employees.

Employees are assigned to complete the training based on their designation in Interim USU Policy 340. You can check the training that you have been assigned to in two ways: 

  • The notice emails sent from the Office of Equity’s prevention team (prevention@usu.edu) will include your designation and required training course name.  
  • The course you are assigned to complete in the ILS will match the required training course name in the notice emails.

Designated Confidential Resources, Reporting Employees and many new, non-designated employees are required to attend a training “live,” either on Zoom or in person (Blanding, Eastern, and Logan campuses). The training for these groups of employees requires “live” attendance so employees have the opportunity to better understand Interim USU Policy and Procedures 340 through interactions with the instructor and their peers.

The following non-designated employees are required to complete an annual training in an online, self-paced course: 

  • Continuing, full-time benefited employees 
  • Wage hourly employees who are: 
    • Office or staff assistants, receptionists 
    • Peer mentors/advisors 
    • Undergraduate teaching fellows 
    • Undergraduate teaching and research assistants 
    • Classroom and broadcast facilitators 
    • Tutors  
  • Wage hourly employees who work in:

New reporting employees are required to take a 2-hour training so they have a solid foundation for reporting and responding to disclosures of sexual misconduct in their role at the university. New full time employees who are not reporting employees have a 90-minute training requirement.

Continuing reporting employees who have previously taken the training are required to take a 90-minute training so they have an opportunity to ask questions, review information, understand reporting requirements, and build more skills related to responding to sexual misconduct disclosures.

Both students and employees at USU have an annual sexual misconduct (Title IX) training requirement. Individuals with multiple university roles will be required to participate in each of the sexual misconduct (Title IX) trainings that is required for each of their roles. All of USU’s sexual misconduct (Title IX) trainings review unique content and attendance cannot be substituted between them. 

Common reasons: 

  • Some student employees (such as graduate assistants and resident assistants) are required to take both the sexual misconduct (Title IX) training for employees and the student prevention training. This means they will have to complete two separate trainings due to their dual roles as both students and employees at USU. Additionally, some students have an additional training requirement due to participation in athletics, fraternity and sorority life, and student organizations.  Review student training requirements here. 
  • Some employees change reporting obligations designations during the fiscal year and are required to attend a portion of a second training to learn about their new reporting obligations. (For example, an employee may be a non-designated employee and later become a supervisor. All supervisors are Reporting Employees, so the employee would need to take an additional training to learn of their new obligations as a Reporting Employee.) If this applies to you, you’ll receive a notice email from the Office of Equity with information regarding the second training requirement. 
  • Attendance records sometimes have errors. If an employee already attended the appropriate employee sexual misconduct (Title IX) training since July 1 of the current fiscal year, they can email prevention@usu.edu with the time and date they attended so we verify their attendance.

We are typically unable to offer training exemptions for employee trainings, but employees who have had past traumatic experiences related to sexual misconduct may request training alternative by completing the Qualtrics form linked in the training notice email. You are not required to give specifics as to why you are requesting this training alternative.

If you would like an exemption from the training as an accommodation for a disability, you will need to contact Angie Clayson (angie.clayson@usu.edu) and engage in an interactive process to determine reasonable accommodations. You are not required to give specifics to the Office of Equity as to why you are requesting an accommodation for a disability. 

Yes, you can request an accommodation due to a disability by completing this form. You are not required to give specifics to the Office of Equity as to why you are requesting an accommodation for a disability, but you will need to work with Angie Clayson in Human Resources in an interactive process to determine reasonable accommodation(s).

All supervisors are “reporting employees” in Interim USU Policy 340. 

As defined by Human Resources, you’re considered a supervisor if you approve someone’s AggieTime or MyTime—even if it’s only temporary or for payroll purposes. Supervisor information is automatically pulled from Banner. You can work with your department’s business services representative to make any updates or changes in Banner.

If you’re using MyTime to temporarily approve time, you can be setup as a delegate or proxy without being given supervisory status. This ServiceNow article provides more information. 

If you’re using AggieTime to temporarily approve time, there is not a delegate or proxy function, so you’ll need to email prevention@usu.edu for next steps. 

If you work in Business Services and need access to certain functions for payroll purposes, please work with Danielle Anderson (danielle.anderson@usu.edu) in Human Resources to ensure your access is appropriately set up for your role.

Training Deadline

Employees have different training deadlines depending on their role within the university.  

Your training deadline is included in the notice email you received from the Office of Equity. The ILS may not accurately reflect training deadlines due to software limitations, so always refer to the notice email from the Office of Equity for your deadline. Please email prevention@usu.edu if you’re unsure when your training is due. 

Training deadlines are generally as follows: 

  • New employees 
    • New Reporting Employees: 60 calendar days from notice date 
    • New Non-Designated Employees: 60 calendar days from notice date 
    • New Designated Confidential Resources: 30 calendar days from notice date 
  • Continuing employees 
    • All Designated Confidential Resources: First day of fall semester classes or 60 calendar days from notice date (whichever is longer) 
    • Certain Reporting Employees (listed below): First day of fall semester classes or 60 calendar days from notice date (whichever is longer)

Training availability depends on your campus location and what training you’re required to attend. You can view the current training schedule on this webpage in the "complete your training" section. You will need to sign up through the ILS to view venue information (location or Zoom link).

Please pay close attention to the course name when you are signing up in the ILS. You will need to attend the correct course for your employee designation (Reporting Employee or Non-Designated Employee). If you attend the wrong course, you may not receive credit for attending.  

If you miss your training deadline, you’ll be considered noncompliant with your training requirement. Your supervisor may choose to implement corrective action (such as a verbal or written warning) per USU Policy 311 if you are a non-faculty staff member or USU Policy 407 if you are a faculty member. Deans and VPs will also be notified of your non-compliance. An employee’s paycheck will never be withheld because they missed a training deadline. 

Per USU’s Department of Justice resolution agreement (section VIII.C.7.), the names and job titles of employees who are noncompliant with their training deadline will be reported to the United States Department of Justice on January 31 or June 30 of each year. The report indicates if an employee attended a training after their deadline or did not attend a training by the applicable reporting date. 

You can address your non-compliance by attending a training as soon after your deadline as possible. A schedule of upcoming trainings can be found on this webpage in the "complete your training" section.

You do not need to attend the training until you return from sabbatical, FMLA, or disability leave. You will have 60 calendar days from the day of your return or until the first day of fall semester classes/October 15 (whichever is longer) to attend the training.  

If you are on sabbatical, FMLA, or disability leave and are not able to attend a training by your assigned deadline, please email prevention@usu.edu so we can update our records. 

Training Attendance

Yes. The employee sexual misconduct (Title IX) training is an annual requirement for employees at USU. You’re required to attend the training by your deadline each fiscal year (July 1– June 30), even if you’ve attended one of these trainings in the past. 

It’s important to attend this training annually because revisiting these conversations helps employees continue to improve on recognizing and responding to sexual misconduct disclosures. Trainings also address any relevant changes to USU’s policies and procedures.

Yes. The student and employee trainings are separate and different training requirements. The employee sexual misconduct (Title IX) training focuses on your obligations to respond to sexual misconduct because you are an employee at USU.

You must attend the full training (90 or 120 minutes) to receive attendance credit. If you’re unable to attend a full training, email prevention@usu.edu. 

If you attend in person, you’ll need to sign in on the attendance sheet provided at the training. 

If you attend virtually, ensure your Zoom profile name is your first and last name. The instructor may ask you to send your A# in the Zoom chat to help take attendance. 

Attendance is manually updated by the instructor in the ILS. It will be updated within 2-3 business days after the training occurs. The course may take up to 2 business days to show as “complete” in your ILS MyLearning dashboard.

Yes. If you are an employee at USU, this training is part of your employee job duties, and you should be compensated accordingly. Please attend the training as part of your regularly scheduled work time. You can contact your supervisor or Human Resources if you have additional questions about compensation in your role. 

If you hold multiple hourly positions within the university and are unsure which position requires the training, email prevention@usu.edu or contact your supervisor. 

No. All employees can choose to attend the training virtually via Zoom. Employees at Logan and Blanding campuses have an additional option to attend in person. The ILS instance name will indicate if the training session is an in-person session or a virtual Zoom session. In-person sessions will include the campus location.

No. This training covers USU-specific policies and procedures related to Title IX and your USU employee obligations, so you will also need to attend an employee sexual misconduct (Title IX) training at USU.

Training Access

You can sign up for a training by logging into the ILS and following these instructions. Note: The ILS does not work on mobile devices. Please sign up using a desktop computer.

  • The name of your course may be different from what’s listed in the instructions. All course names include “Title IX”.
    • Courses you’ve already attended will be marked as “complete” in your MyLearning dashboard.
    • Courses you did not complete in the past will remain as “incomplete” in your MyLearning dashboard. Read through the course overview to learn if the course is active.
    • Note: Trainings for Reporting Employees and Designated Confidential Resources are not available as recordings or self-paced courses. Any pre-recorded or self-paced training is not the correct training if you are designated in one of those two categories. You must attend a training “live”, either in person or via Zoom, to receive credit.
  • You’ll know you’re in the correct course when you’re able to choose an “instance” that works best for your schedule (step 3 in the instructions). Each instance is associated with a specific date and time.
    • The ILS will only show a few available trainings at a time. To view all available times, hover over the “instance” dropdown menu and start scrolling. Times and dates may not be in chronological order due to software limitations.
  • Don’t forget to click the blue “update enrollment” button in the upper right corner of the screen to confirm the time you selected (step 4 in the instructions). 

Note: If you are a new employee, it can take up to 30 days from your hire date before you’re able to access the course in the ILS. You’ll receive an email from the Office of Equity (prevention@usu.edu) to your @usu.edu email account when you’re able to access the course. 

If you aren’t able to sign up for the training after following these steps, email prevention@usu.edu.

ILS and Outlook notifications use your application’s time zone to send reminder emails and calendar invites. The actual time of the training is listed in the instance name in Mountain Time. Ex: Virtual July 7, 2022 (10:00 AM – 12:00 PM MDT) 

If your ILS or Outlook email profile settings are set for a time zone other than Mountain Time, notifications and reminders will automatically update the time to reflect the time zone difference. 

All employees and students at USU are given a USU email address used for all institutional email business per USU policy 557. You can access your USU email by following these instructions or by contacting USU IT. (Note: While the instructions are for students, email set up is the same for employees.)  

If you are not an employee or student and do not have a USU email, email prevention@usu.edu to access the training. 

The instance name in the ILS for each session will indicate the format of the training.

Blanding and Logan campus employees can attend a training either in-person or virtually on Zoom. All Eastern and Statewide campus trainings are on Zoom. Training sessions are not available as hybrid trainings with both in-person and Zoom formats for the same session, so you need to sign up for a training in the format you wish to attend. In-person sessions will include the campus location.

To access the training virtually, you’ll need to sign up for an instance in the ILS that is labeled “virtual”. In person instances do not have a Zoom option.

The Zoom link and Zoom passcode for the training can be found in the ILS’s venue information for the instance you select. After you enroll in an instance, you’ll receive an email to your @usu.edu email with the venue information, including the Zoom link and passcode.
 

If you cannot find the Zoom link or passcode, email prevention@usu.edu at least 1 business day before the training date.  

If you are having Zoom issues on the day of the training, do not contact the training’s facilitator directly for Zoom information or troubleshooting assistance. They will not be able to respond to emails or phone calls due to facilitating the training.

There is no pre-recorded option for the training for employees designated as Designated Confidential Resources and Reporting Employees. The training for these groups must be attended “live”, either in person or virtually via Zoom.  

The following non-designated employees are able to complete the training in an online, self-paced course:

Training Requirement

When employees that you supervise are enrolled in the sexual misconduct (Title IX) training, you’ll receive an email to your @usu.edu email account from the Office of Equity (prevention@usu.edu) with additional information.  

You can also check the ILS in your “manager” role to view Title IX training completion and requirement records for any employees you supervise. View the Manager ILS Guide for additional information. 

Yes. You can choose to opt employees into this training. While the training is mandatory for many employees, some employees (usually wage hourly employees) are not required to attend.  

If you would like to opt one or more of your employees into the required training, email the Office of Equity (prevention@usu.edu). 

Employees who are on sabbatical, FMLA, or disability leave do not have to attend the training until they return from sabbatical or leave. They will have 60 calendar days from the day of their return or until first day of fall semester classes/October 15 (whichever is longer) to attend the training.

Please email prevention@usu.edu if one of your employees is on sabbatical or leave and receives notice from the Office of Equity that they are required to complete the training.

If one of the employees you supervise is on sabbatical, FMLA, or disability leave, you are responsible for ensuring they complete the appropriate training. After they return to work, you or the employee should email prevention@usu.edu to get them re-enrolled in the training.

Training Notifications

If an employee you supervise is required to attend a training, they’ll receive a notice email from the Office of Equity (prevention@usu.edu) to their @usu.edu email account. Please encourage them to check their @usu.edu email frequently.  

Employees will receive multiple reminder emails from the Office of Equity (prevention@usu.edu) and the ILS leading up to their training deadline.  

For continuing employees during the compliance training period (July–October), you’ll receive multiple email notifications from the ILS during those months.

Additional reminder emails may be sent from the Office of Equity’s prevention team, particularly for supervisors who have employees with a first day of fall semester classes deadline. 

Once a month, deans and VPs are sent a list of noncompliant employees who are still noncompliant after 30 or more days. During the compliance training period, they may receive additional notices about employees who have an upcoming training deadline (first day of fall semester classes and October 15). 

For new employees or employees who return to the university outside of the compliance training period (July–October), you’ll receive email notifications as follows: 

  • Initial email when an employee is enrolled in a training. 
  • Notice email when an employee has a deadline approaching in the next few weeks. 
  • Notice email 1-2 business days after an employee has missed their training deadline. 

Supervisory Status

The ILS populates manager dashboards based on your supervisory status in Banner. You’re considered the supervisor of anyone whose time you approve in AggieTime or MyTime.  

If the ILS shows an employee who you do not supervise, contact your department’s business services representative to correct your direct reports list in Banner. If you supervise an employee who is not showing up on your ILS dashboard, you’ll need to contact your department’s business services representative to correct the issue.

If you are listed as an employee’s supervisor in Banner, but they do not show up on your ILS manager dashboard, the employee is not yet required to take an employee sexual misconduct (Title IX) training or they have another job at the university that requires the training. The ILS only shows an employee’s primary position and supervisor if they have more than one position at USU.
