New ADA Title II Digital Accessibility Ruling

The Department of Justice (DOJ) has published a new rule on digital accessibility under the Americans with Disabilities Act (ADA) impacting public higher education institutions. This rule requires that most of the university’s digital content be accessible by April 24, 2026. 

Accessibility is Everyone’s Responsibility

In order to meet these requirements, everyone at Utah State University will need to learn and apply accessibility best practices.

The Standard

Web Content Accessibility Guidelines (WCAG) 2.1 is the technical standard for compliance with the new rule. We have a number of tools that make it easy to identify and fix many issues. We encourage you to reach out to the Digital Accessibility Services Office to review your digital content and discuss where you can get started to create more accessible content.

  • Social Media
  • Video Content
  • 3rd Party Content
  • Mobile Applications
  • Electronic Documents

Exceptions

There are a few exceptions to the new rule, but it’s important to keep in mind that almost all content will need to meet the new requirement. The following content may be considered for exceptions:

  • Archived Web Content
  • Electronic documents on a site or app before the date of the rule
  • Content posted on a site or app from a 3rd Party
  • Password-protected documents for specific individuals
  • Social Media posts posted before the date of the rule
